You acknowledge and understand that we collect your personal data:
We process your personal data based on the following legal grounds and for the following purposes:
Processing necessary for the performance of the contract entered into between you and us.
Since the basis of our Service involves selecting a "Partner" capable of granting you a loan—based on information regarding the loans they offer, the aforementioned sources, and the credit profile we have created for you using those sources (see also the "Profiling and automated decision-making" section below)—we will process your personal data primarily to fulfill the Agreement established with you. This includes finding a suitable Partner that meets your needs, as well as pre-filling the loan application for repeat requests and improving your credit profile and score if you already hold an Account. It also includes providing you with support and contacting you regarding the Services. It may also involve taking necessary steps prior to entering into the Agreement (e.g., verifying, based on your official identification and address, that you are authorized to use our Services under our Terms and Conditions). For the avoidance of doubt, we retain the personal data processed in connection with the use of our Services.
To provide the Services, we collect, process, and store the following personal data:
Processing based on legitimate interest
We process data generated through the use of our Site and Services, as well as data received from third-party services, to understand and analyze usage trends and User preferences. This allows us to improve the Site and Services and to develop new products, functionalities, and features. Should this require the processing of your personal data, such data will be used in an anonymized or aggregated form.
Likewise, we process data obtained from the use of the Site (e.g., information on how you browse and use our Site) and our Services to prevent fraud and the misuse of our Site and Services (e.g., preventing the use of the Site and Services by bots).
We may need to process your data to make inquiries with third-party financial solvency service providers, in accordance with applicable regulations. If we do not carry out this processing, we may be unable to provide you with our Services.
. We may also process your personal data to safeguard our rights (e.g., establishing, exercising, and defending legal claims; debt collection).
Your interests or fundamental rights do not override our legitimate interest.
To the extent required by applicable data protection regulations, you have the right to object to the processing of your personal data based on legitimate interest (see also the “Your rights” section below).
Processing based on your consent
We may process your personal data based on your consent when sending you advertising communications—by any means, including electronic communications (e.g., email, SMS)—and for profiling activities used for such marketing communications. Additionally, we may send marketing communications to your WhatsApp number if you have provided your consent. Consent may be withdrawn at any time; however, this will not affect the lawfulness of processing based on consent prior to the withdrawal.
You may opt out of receiving marketing communications at any time by clicking the “unsubscribe” link at the bottom of any email, SMS, or WhatsApp message. Unsubscribing from one channel (e.g., email) does not mean you have unsubscribed from another (e.g., SMS or WhatsApp). Please note that withdrawing consent does not affect the lawfulness of data processing carried out prior to such withdrawal.
Furthermore, provided you have given your consent, we may share your personal data with our Partners and/or third parties operating in the financial sector so that they may send you commercial communications regarding their products and services. Such marketing communications are sent directly by the Partner or third party. Please note that this consent is voluntary and may be withdrawn at any time by contacting the sender of the marketing communication.
Data processing based on our legal obligation.
We may process your personal data to comply with our legal obligations (e.g., our obligation to share your personal data with relevant authorities and to meet our obligations regarding the prevention of money laundering and terrorist financing). This type of processing is based on compliance with our legal reporting obligations.
We do not process any special categories of personal data, nor do we process personal data related to criminal records or data concerning minors.
We use profiling and automated decision-making in the following ways:
Profiling and automated decision-making as part of our Service: taking into account your preferences for taking out a loan with us and the personal information you have provided when creating your Account or completing the loan application form, as well as information obtained from the sources listed above and your history of using our Services (e.g., whether you have been granted a loan and by whom), we create or complete your credit profile and credit score, subsequently assigning the results to your Account. We compare your profile against the conditions established by each Partner for their customers; based on the results of this comparison, we offer you the Partner—or list of Partners—most likely to grant you the loan under the conditions you have pre-selected. Our results are based on information received from Partners regarding the conditions they offer their customers, as well as our best estimate based on the Partners' past practices. Depending on the outcome of our comparison, the list of potential Partners may be extensive or, conversely, contain only one potential Partner or none at all; this depends on how many Partners—based on our best estimate—would be willing to grant loans to individuals with profiles similar to yours. To understand the basis for each Partner's preferences, please consult the Partners' privacy policies available on their websites.
We will supplement the credit profile and score assigned to your Account by taking into account your subsequent credit behavior, based on the information about you to which we have had access. A higher credit profile and score will enable you to secure better terms when formalizing a loan agreement. Please note that you may delete your credit profile and score at any time by deleting your Account.
Since the automated profiling described in this Privacy Policy forms the basis of the Service we provide to our customers (including you), such profiling is necessary to perform the Agreement existing between us (see also our Terms and Conditions).
As a result of such automated profiling, we may conclude that there are no Partners willing to enter into pre-contractual negotiations with you, based on your pre-contractual preferences. Please note that, in such cases, you may change the terms of the loan you are seeking (e.g., reduce the principal amount), which could enable us to find a potential Partner for you. Therefore, the results of our profiling cannot be considered to significantly affect you or your interests, including by depriving you of the opportunity to obtain a loan. You have the right to obtain human intervention, to express your point of view, and to contest the decision.
We also create profiles of our users in order to provide them with offers—both our own and those of our partners—that we believe may be of interest to them. To this end, we create a profile of you based on information regarding your use of our Site and your personal data (primarily your age and gender). Please note that we request your explicit consent to carry out this type of profiling and marketing, and that you have the right at any time to withdraw the consent given for the processing of your personal data for these purposes, either through your Account or by contacting us.
Partners. For the provision of Services, you acknowledge and authorize us to share your personal data with our Partners. The Partner will use your personal data for the sole purpose of deciding whether or not to grant you a loan or provide another financial product offer you have requested. By clicking "Continue" or proceeding with the application process on our Site, you authorize us to transmit information for this purpose. The list of Partners with whom we share your personal data may change. You can access the current list via the following link. The purpose and legal basis for such sharing of personal data is to enable the performance of the Agreement between us and the proper provision of our Services.
Please familiarize yourself with the relevant Partner's privacy policies. As part of this Privacy Policy, you acknowledge and accept the privacy policies of our Partners (<list of Partners>) with whom we share your data for the provision of Services. Our partners' privacy policies can be found on their websites.
Please note that the Partner may only process your personal data for direct marketing purposes if you have given your consent for such processing. You may withdraw your consent by contacting the Partner directly.
If the Partner decides not to make a loan offer to you, the Partner is required to delete or anonymize your personal data, unless there is a valid legal basis for retaining your data.
Third parties. For the provision of the Services, you acknowledge and authorize us to share your personal data with the following third parties:
- Service providers authorized to receive your personal data based on your consent;
- For inquiries regarding your financial creditworthiness;
- External service providers that provide us with services such as website delivery platforms, application development, hosting, maintenance, email, SMS and WhatsApp services, marketing services, and other services;
- Third parties that assist us in protecting our legal rights (e.g., lawyers and debt collection agencies). The legal basis for this sharing lies in our legitimate interest in protecting our legal rights and ensuring compliance with the Agreement between us. In such cases, your interests or fundamental rights and freedoms do not override our legitimate interests.
- Third parties that assist us in complying with our legal obligations (e.g., auditors, authorities). The legal basis for this sharing lies in the need to comply with our legal obligations.
We also reserve the right to disclose your personal data if we believe, in good faith, that it is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or illegal uses or activities, (iii) investigate and defend against any third-party claims or allegations, (iv) protect the security or integrity of the Service, or (v) protect our property or other legal rights, enforce our contracts, or protect the rights, property, or safety of others.
We have carefully selected the parties responsible for processing your personal data. We only engage external service providers that offer sufficient guarantees to implement appropriate technical and organizational security measures to protect your personal data. We have entered into appropriate data processing agreements with our external service providers and will be responsible for their actions regarding the processing of your personal data.
These third parties may have access to or process your personal data as part of providing those services to us. We limit the information provided to these service providers to what is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information.
Your information will be collected, processed, and stored within the EU.
Whenever we (for example, in order to provide Services to you) or data processors acting on our behalf transfer personal information to countries outside the European Economic Area, we will ensure that the information is transferred in accordance with this Privacy Policy and as permitted by applicable data protection laws.
For more detailed information regarding the transfer of your personal data outside the EU (such as the names of recipients and the specific legal basis for such a transfer), please contact us using the contact details provided below.
We have implemented a range of technical and organizational measures to ensure that your personal data is adequately protected, taking into account (i) the state of the art, (ii) implementation costs, (iii) the nature, scope, and purpose of the processing, and (iv) potential risks.
We retain your personal data for as long as necessary to fulfill the purpose for which it was provided, as well as for the time required to protect your rights as mandated by applicable regulations. We may retain your personal data for a certain period following the termination of our relationship if necessary to protect your rights in accordance with applicable regulations. If there are multiple purposes for the processing of your personal data, the data will be retained in accordance with the longest applicable retention period.
In accordance with the maximum statute of limitations for claims arising from these transactions under applicable law, where the obligated party intentionally fails to fulfill their obligations, we may retain your personal data related to such claims for a maximum of 10 years from the date the claim becomes due.
As established by applicable regulations, you have all the statutory rights regarding your personal data. These rights include, among others, the following:
Please note that rights regarding your personal data are not absolute and are subject to considerations permitted by applicable law.
To exercise your rights, please contact us using the contact information provided at the end of this Privacy Policy. Please note that you can exercise some of your rights (e.g., reviewing and updating your personal data) immediately by logging into your Account.
If you believe that your rights regarding your personal data have been infringed, please contact us using the contact information provided at the end of this Privacy Policy. Additionally, you have the right to file a complaint with the Data Protection Inspectorate or take legal action in court.
Furthermore, if you believe your rights regarding personal data protection have been violated, you have the right to appeal to the National Institute for Transparency, Access to Information and Personal Data Protection (INAI): Home.
We reserve the right to modify this Privacy Policy from time to time. If we make changes, we will publish the modified Privacy Policy on the Site and indicate the date of the last revision at the top of this page. The revised version will become effective as soon as we publish it. You understand and agree that your continued use of the Services or the Site after we have made such changes constitutes your acceptance of the new Privacy Policy.
